General terms and conditions

Objective

JUNGLE BOX provides the vast majority of course services to the customer, which the latter agrees to pay at the rate in effect at the time of payment.

Rates

The price of each course is deducted from the amount paid in advance by the customer in accordance with point 3 below, until the credit is exhausted.

Prices are indicative only. JUNGLE BOX reserves the right to modify them without prior notice. In the event of a price increase, the customer will continue to benefit from the price in force at the time of payment, until the corresponding credit is exhausted.

Payment and validity

All services (private lessons, groups, packs, subscriptions) are payable in advance.

Group lessons, packs and subscriptions are payable via Momence or at the studio (Twint, cash, bank transfer).

Private lessons (Personal Training) are payable at the studio only (Twint, cash, bank transfer).

Services are provided by JUNGLE BOX. No service is guaranteed with a specific provider.

No refunds will be given, even in the event of absence, change of coach or cancellation.

Packs have a limited validity period, indicated at the time of purchase. Unused sessions are lost.

Subscriptions have a minimum commitment of 3 months, renewable automatically and payable monthly in advance.

Cancellation is possible after 3 months, with 30 days’ written notice.

Early termination is only accepted in the event of a move of more than 100 km, upon presentation of proof.

Unused credits can be transferred to a third party before expiry, upon written request.

Suspension of subscriptions and packs

Only memberships with a minimum commitment of 3 months (6, 12 sessions/month or Jungle Unlimited) can be suspended once, for a maximum of 2 weeks, on presentation of medical or professional proof.

Packages and other services cannot be suspended.

All suspension requests must be sent by e-mail before the desired start date.

Suspensions for personal reasons, vacations, departure/change of coach, or internal reorganization are excluded.

During suspension, the subscription is frozen, including payments, and the commitment period is extended accordingly.

Booking and course schedule

All lesson bookings can be made in advance or directly at the studio, subject to availability. Reservations can be made online via the Momence system at www.junglebox.ch or directly with the studio.

No guarantee is given as to the availability of courses, reservations being honored according to their priority in time, nor as to the identity of the instructor for a given course. The course schedule is subject to change at any time. The schedule updated on the Momence reservation system is authoritative.

All courses require a minimum of 3 participants. If the number of participants is not reached 12 hours before a morning course, the course may be cancelled. If the number of participants is not reached 12 hours before a lunchtime or evening course, the course may be cancelled.

JUNGLE BOX also reserves the right to refuse access to the studio to a customer who does not respect the studio environment or to expel a customer from the studio during a class if the customer interferes with the practice of other participants.

Course cancellations and delays

Reservations can be cancelled with a minimum of 24 hours’ notice. In the event of cancellation without respecting this deadline, for packs and subscriptions, the course will be credited.

For any customer who registers for a course and does not respect the cancellation deadline during a full course, the customer will receive an e-mail and will have their Momence account blocked for 7 days.

The blocked account still allows you to come and train at the studio, but only restricts the possibility of booking a lesson online.

If the customer wishes to unblock his account, he must do so directly at the studio reception desk, paying an unblocking fee of CHF 25.

This is to prevent another customer from booking a full course.

Any early or late cancellation not made by the customer via the Momence platform is void.

If the customer does not wish to comply with this cancellation policy, he/she has the right not to register for the course. The customer has the right not to register for a course. In this case, the customer takes the risk of arriving at a cancelled or full course.

Ideally, the customer should arrive 10-15 minutes, but no later than two minutes before the start of the lesson. If this is not respected, JUNGLE BOX reserves the right to allocate a space reserved by the customer to another waiting customer. Any delay will also result in a late cancellation.

Liability

In its relationship with the customer, JUNGLE BOX generally declines all liability, with the exception of damage caused intentionally or by gross negligence.

JUNGLE BOX classes include physical exercise, relaxation and relief of muscular tension. As with any physical activity, the risk of injury is always present and cannot be totally eliminated. Consequently, the customer confirms that he/she is fully responsible for any injury that may occur during the course. The client undertakes to follow the instructions presented during the course and to practice at a level of intensity that suits him/her.

The courses are not a substitute for medical treatment, diagnosis or examination, and are not recommended under certain conditions. The customer decides for himself whether he is fit to take the course. The customer waives all claims against JUNGLE BOX for the various courses offered.

Customers are also solely responsible for the security and integrity of any personal belongings they bring with them to class and/or leave in the checkroom.

Customer health information

The courses offered by JUNGLE BOX do not constitute medical training. As with any physical training, there are a number of health risks, which the customer acknowledges and accepts.

These risks may be increased by the existence of factors related to the customer’s health. For this reason, JUNGLE BOX can only agree to provide services to the customer on the express condition that the customer

  • inform JUNGLE BOX, no later than the first class, if he/she suffers from a heart, respiratory or joint condition;
  • spontaneously inform JUNGLE BOX of any other circumstances relating to the customer’s health or medical history (including cosmetic surgery) which may affect or be affected by the courses offered by JUNGLE BOX ;
  • shall immediately inform JUNGLE BOX of any change in the situation resulting from the information initially provided in accordance with the above.

In case of doubt, it is the customer’s responsibility to consult a physician of his/her choice, at his/her own expense, prior to making the first payment, in order to clarify his/her suitability for JUNGLE BOX physical training and to inquire about any relevant circumstances that may be unknown to him/her.

It is the sole responsibility of pregnant women to determine with their doctor whether the nature of a JUNGLE BOX course is possible as their pregnancy progresses.

The client must carefully follow the instructions given by the instructor during each class. In the event of discomfort, shortness of breath, dizziness, fluctuations in heart rate, muscular pain or any other physical symptom during a class, the customer undertakes to stop the exercise spontaneously and inform the instructor immediately.

JUNGLE BOX shall not be liable for any damage to the customer’s health resulting from the customer’s failure to comply with the foregoing obligations.

Electronic communications

The registration process, the payments involved and the course reservations can be made online via the Momence system accessible on the www.junglebox.ch website. Electronic communication between the customer and JUNGLE BOX via the Momence system on the www.junglebox.ch website is secure. However, it is not possible to provide an absolute guarantee that they cannot be intercepted by third parties. The customer’s attention is drawn to the fact that registration, payment and booking of courses are also possible at the studio. By proceeding with online registration, payment or booking in the Momence system accessible via the www.junglebox.ch website, the customer accepts the risk inherent in this type of communication.

The preferred form of communication of JUNGLE BOX with the customer is the electronic mail. The e-mails exchanged between JUNGLE BOX and the customer within the framework of these terms and conditions will not be protected. It is therefore possible that these communications may be intercepted by third parties. Following the process of inscription, the customer has the possibility of refusing any communication of JUNGLE BOX by e-mail. If the customer does not do so, or if, after having done it, the customer nevertheless communicates with JUNGLE BOX by e-mail, the customer accepts the risk inherent in these communications.

Data protection

During the registration process and the resulting relationship, JUNGLE BOX collects a certain amount of personal information about the customer (including name, address, telephone number, date of birth, gender, occupation, user name, password and answer to a security question for online services in the Momence system accessible via www.junglebox.ch, e-mail address, information on the customer’s state of health, the number, expiry date and any security codes of the customer’s credit card, the IP address of the computer used by the customer to connect to the Momence system accessible via the www.junglebox.ch website).

This collection takes place during the customer’s registration, via the Momence system accessible via the www.junglebox.ch website or at the studio, during payments made by the customer, in connection with discussions between the customer and JUNGLE BOX representatives in person, by telephone, by mail, by e-mail or by other means of communication, as well as during the customer’s participation in courses.

The information collected is used by JUNGLE BOX, among other things, to manage the relationship with the customer (payments, reservations, organization of courses, etc.), to tailor services to the customer, to verify the identity of the customer, to conduct market research, to send information and other communications to the customer (unless the customer has indicated that he does not wish to be contacted by JUNGLE BOX).

The customer’s personal data is processed via the Momence software platform, which complies with the common European data protection rules established by the GDPR.

JUNGLE BOX will not divulge personal data relating to the customer to a third party, unless obliged to do so by law or by the decision of a competent authority.

When using the Momence system services accessible via the www.junglebox.ch website (information, registration, payment, course reservation, etc.), the customer’s IP address may be automatically recorded on the Momence server, for identification and statistical purposes, and information may be automatically stored on the customer’s computer, in the form of “cookies”, in order to facilitate the use of the Momence system accessible via the www.junglebox.ch website and to improve the quality of the service.

JUNGLE BOX may take photos and videos in the studio for marketing purposes. JUNGLE BOX is at liberty to select images, edit them and cut them to fit the customer’s image.

Applicable law and competent courts in the event of a dispute

Swiss national law is exclusively applicable. In the event of a dispute, JUNGLE BOX and the customer submit to the exclusive jurisdiction of the competent ordinary courts of Lausanne (VD).

The sources of the general terms and conditions are in French. In the event of any discrepancy between the English and French versions, the French version shall prevail.
